The proposed legislation requests authorization of S373,300,000 for

A BILL To authorize appropriations to the Nuclear Regulatory Commission 1n accordance with section 261 of the Atomic Energy Act of 1954, as amended, and section 305 of the Energy Reorganization Act of 1974, as amended,. and for other purposes.

Be it enacted by the Senate and the. House of Representatives of the United States of America in Congress assembled, TITLE I AUTHORIZATION 0F APPROPRIATIONS FOR FISCAL YEAR 1980 Sec. 1(a) There is hereby authorized to be appropriated to the Nuclear Regulatory Commission in accordance with the provisions of section 261 of the Atomic Energy Act of 1954, as amended, (42 U.S.C. 2017) and sections 305 of the Energy Reorganization Act of 1974, as amended, (42 U.S.C. 5875) for the fiscal year 1980 to remain available until expended $373,300,000 to be allocated as follows:

(1) For " Nuclear Reactor Regulation", $57,040,000, (2) For " Inspection and Enforcement", $41,200,000, (3) For " Standards Development", $14,270,000, (4) For " Nuclear Material Safety and Safeguards", $29,605,000, (5) For " Nuclear Regulatory Research", $185,570,000, (6) For " Program Technical Support", $14,925,000, (7) For " Program Direction and Administra. tion", $30,690,000.

Sec. 1(b) Of the total amount authcrized under section 1(a), the Commission nay reprogram from or into program activities specified in sub-section (a) an amount not exceeding $10,000,000 except that the amount transferred from or into any of the major program activities specified in subsection (a) shall not exceed 15 per centum of the amount so specified.

Prior to any rer ogramming of an amount in accordance with the provisions of this subse tion, where such amount is in excess of $500,000, the Commission shall inform the appropriate Congressional committees.

Such reprogramming may be made notwithstanding the limitations of subsection (a).

Sec. 2.

Monies received by the Commission for the cooperative nuclear research programs may be retained and used for salaries and expenses associated with those programs, netwithstanding the provisions of section 3617 of the Res ised Statutes (31 U.S.C. 484), and shall remain available until expended.

Sec. 3.

Transfers of sums from salaries and expenses may be made to other agencies of the Governnent for the performance of the work for which the appropriation is made, and in such cases the sums so trans-ferred may be merged with the appropriation to which transferred.

TITLE II AUTHORIZATION OF APPROPRIATIONS FOR FISCAL YEAR 1981 Sec. 1.

There is hereby authorized to be appropriated to the Nuclear Regulatory Commission such sums as may be necessary for fiscal year 1981.

' TITLE III AUTHORITY TO MAKE PAYMENTS Sec. 1.

Notwithstanding any other provision of this Act, no authority to make payments under this Act shall be effective except to such' extent or in such amounts as are provided in advance in appropriation Acts.

U. S. NUCLEAR REGULATORY COMMISSION ANALYSIS OF PROPOSED BILL FOR AUTHORIZATION OF APPROPRIATIONS UNDER SECTION 2610F THE ATOMIC ENERGY ACT OF 1954, AS AMENDED SECTION 305 0F THE ENERGY REORGANIZATION ACT OF 1974, AS AMENDED FISCAL YEAR 1980 AND FISCAL YEAR 1981

TITLE I AUTHORIZATION OF APPROPRIATIONS FOR FISCAL YEAR 1980 Section 1(a) Calaries and Expenses. The Nuclear Regulatory Commission is responsible t :r assuring that the possession, use and disposal of radioactive materials and the construction and operation of reactors and other nuclear facilities are conducted in a manner consistent with public health and safety and the coamon defense and security, with proper regard for environmental quality, and in conformance with antitrust statutes.

The Commission's program is comprised of nuclear facilities and materials licensing and related regulatory functions, inspection and enforcement, standards development, reactor safety research, nuclear materials safety and safeguards, rulemaking, and technical and administrative support activities.

The budget request for the Commission is stated in terms of obligational authority requested to carry out the responsibilities of the Commission.

For fiscal year 1980, the requested total authorization for appropriations is $373,300,000.

Section 1(b) This section provides the Commission with the authority to reprogram funding among the orogram activities specified in subsection 1(a) with the following constraints:

No program activity may be increased or decreased by more than

$10 million from the amount authorized in subsection 1(a).

No program activity may be increased or decreased by more than 15 Der centum from the amount specified in subsection 1(a).

3.

Any reprogramming of an amount in excess of $500,000 will be reported to the appropriate Congressional committees.

Section 2.

This section provides for authorization for monies received by the Commission for cooperative nuclear safety research programs to be used as salaries and expenses and for them to remain available until expended notwithstanding the provisions of section 3617 of the revised statutes.

The NRC in consonance with the Department of State, has entered into a cooperative nuclear safety research agreement with Norway, Sweden, the Federal Republic of Germany and the Republics of Japan, Austria and the Netherlands. They will participate in U. S. reactor safety research experiments including the loss of Fluid Test (LOFT) experiments and will pay for any cost incurred incidental to their participation.

In the future, similar agreements are anticipated with other foreign governments.

Section 3.

This section provides authorization for the transfer of amounts from the Commission's Salaries and Expenses appropriation to other agencies of the Government for the performance of the work or services rendered by such agencies on behalf of the Commission.

TITLE II AUTHORIZATION OF APPROPRIATIONS F0r. FISCAL YEAR 1981 Public Law 93-344, Congressional Budget and Impoundment Control Act of 1974, TITLE VI, Section 607, states that "...any request for the enactment of legislation authorizing the enactment of new budget authority to continue a program or activity for a fiscal year (beginning with the fiscal year commencing October 1,1976) shall be submitted to the Congress not later than May 15 of the year preceding the year in which such fiscal year begins..."

Accordingly, TITLE II requesos authorization of appropriations for FY 1981.

TITLE III AUTHORITY TO MAKE PAYMENTS Section 1.

This section provides language required by the Congressional Budget and Impoundment Control Act of 197t (P.L.93-344), Sec. 401(a).
