APPLICATION FOR WITHHOLDING FROM PUBLIC DISCLOSURE CAW-78-57 NEW ENGLAND POWER COMPANY, NEP-1 & NEP-2 By it.t'.er, dated August 8,1978, New England Power Company (the applicant) submitted information in the form of tables in support of a reply to request for additional information No. 222.1 concerning mass and energy release rate data. The applicant's letter requested that the information which is proprietary to Westinghouse be withheld from public disclosure and provided Westinghouse affidavits CAW-78-57 and AW-76-29. The applicant further requested that correspondence with respect to the proprietary aspects of these affidavits be addressed to you. Your reasons for requesting our withholding these tables from public disclosure, which show mass and energy releases to containment due to a postulated main steam line break, are the same as those previously submitted by Westinghouse letter, dated January 4,1977 from R. A. Weisemann to J. Stolz for another application. In your affidavit, AW-76-29, also submitted with the January 4,1977 letter, you stated that Westinghouse had expended a considerable amount of development effort in formulating the analytical methods, in performing the analyses, in evaluating the data, and in performing engineering and research backup support for this information. Further, you stated that disclosure of this information would be harmful to the Westinghouse competitive position. By letter, dated June 14, 1978, from J. F. Stolz to R. A. Wiesemann, this information was withheld from public disclosure. Our letter, dated November 3,1978, requested a current affidavit pertaining to the material submitted. Your reply, dated December 1, 1978, transmitted an affidavit, dated December 5,1978, and incorporated by reference affidavit AW-76-29 dated July 23, 1976, on Docket Nos. 50-348 and 50-364 which transmitted the same type technical proprietary material. 7902140 M

Wiesemann JAN 2 4 ;g79 We have also found at this time that the right of the public to be fully apprised as to the bases for and effects of the proposed licensing action does not outweigh the demonstrated concern for your competitive position. Our reason for this determination is that the data will be made available to those members of the public, including architect engineers who have a need for its use in designing, constructing, licensing, or operating a plant, under appropriate protective agreements. Accordingly, we have determined that the information should be withheld from public disclosure. We, therefore, approve your request for withholding pursuant to Section 2.790 of 10 CFR Part 2 and are withholding from public inspection the mass and energy release data sought to be withheld in your application CAW-78-57. Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, assure that the consultants have signed the appropriate agreements for handling proprietary data. If the basis for withholding this information from public inspection would change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC.
