RENTFRO Applicant received on January 13, 1979, a copy of a letter from Mr. Wayne E. Rentfro dated December 26, 1978, and addressed to the members of the Atomic Safety and Licensing Board in this docket. As can'be seen frcm the carbon copy list, Mr. Rentfro served copies only on NRC Staff counsel. Counsel for the Applicant received this letter from the Secretary of the Commission. Applicant believes that this letter should be striken frcm the record in this proceeding and hereby moves for an order to that effect for the reasons discussed below.

The December 26 letrer, which purports to describe alleged health effecrs of high voltage transmission lines, is an apparent attempt by Mr. Rentfro to supplement his statement of contentions and therefore is clearly untimely. Mr. Rentfro was one of the parties with whom the Staff had reached a stipulation on contentions and none of the rulings made by the Board at the special prehearing conference, as reflected in the Board's Order Re: Action Taken At Special Prehearing 790206000Gs

Conference dated January 8, 1979, provided Mr. Rentfro with an opportunity to supplement his statement of contentions.-*/ More-over, the lett'r econtains a number of unfounded comments based on data related to 675 Kv and 1,000 KV transmission lines. The transmission lines associated with the Allens Creek project are 345 Kv. Mr. Rentfro sets forth absolutely no basis for the unstated presumption in his letter that the health effects of a 345 Kv line are the same as those associated with transmission lines in the range of 675 Kv to 1,000 Kv. Accordingly, the submission is irrelevant to this proceeding.
