- yf PLEASL TAKE NOTICE, that the Intervenor, Ocean County, moves the Board to impose terms and conditions upon the Ap-plicant's withdrawal of application; to wit:
- 1. npplicant should pay to the Intervenor, County of Ocean, the cost of intervention incurrec by the County of Ocean. An itemized bill of said costs to be submitted upon an Oroer being entered directing the Applicant to pay said costs.

- 2. Applicant should post a bond or cash in lieu of bond in an amount deemed sufficient to cover legal costs and expert costs that ' nil be tut :creu b; intecvenora in the .
event a substantially similar application is filed in the future. Said bonu or cash deposit should be for a term of ten (10) years.
- 3. The Order of Dismissal should be with prejudice.
- 4. That an Order be entered precluding the Applicant from filing a substantially similar cpplication for the next ten (10) years or such other reasonable period of time.
- 5. For such other relief as may be just and appropriate.
The County of Ocean will rely upon the brief filed by the Intervenor, Atlantic County, in this matter.
