Dear Senator Heinz:

,o Thank you for your note of September 30 which forwarded a letter frota Local 1096 of the International Brotherhood of Electrical Workers expressing the concern of the union members about delays in issuance to Westinghouse of several nuclear export licenses.

I have brought their letter and this response to the attention of the senior U.S. Government officials responsible for reviewing nuclear export license applications.

I can assure you that all involved in nuclear export licensing fully recognize the need to eliminate unnecessary delays or uncertainties in the licensing process. At the same time, tSe Conmission and other agencies responsible for reviewing nuclear exports must give careful consideration to ensuring that these exports will not be harmful to our national security and, spccifically, meet the requirements of the Nuclear Non-Proliferation Act of 1978 (NNPA).

While the NNPA provides a framework for expediting the processing of routine nuclear export license applications, the full benefits of its provisions cannot be realized until the Commission and the Executive Branch have performed certain " baseline" analyses concerning particular nuclear commodities and particular importing countries.

Once completed, we expect that these baseline analyses will permit more expedited approval of similar commodities to the same destinations.

With respect to the proposed exports mentioned by Local 1096 involving Korea, Yugoslavia, the Philippines, Taiwan and Spain, sensitive and complex issues, including those arising from the export criteria speci-fied in the NNPA, have had to be resolved in each of these cases. As to their precise status, the NRC is awaiting receipt of the final views nf the Executive Branch from the State Department before it can act on

proposed Philippine reactor export and the Sayago (Spain) fuel export The export license for the Korean reactors was issued on October 4,1978 and the Commission is actively reviewing the other pending exports io Taiwan, Spain and Yugoslavia.

I anticipate final Commission action ;n these cases in the near future.

Pa., we request your attention to our concerns regarding current icplacentation of the P. 7 Nuclear Non-Proliferation Act (NNPA). 3, We are in the nuclear heat transfer tube canufacturing business, processing Inconel and Zircaloy products for use in steam generators and nuclear fuel assechlies for cocaercial power stations, world-wide. 9 DQQ Our 600 people are 50% dependent on export business and are concerned A' about our long tern job security, based on the significant delays 'l taking place in the, issuance of necessary export licenses. At present, through conversations with our management, and our own 4g investigation, we know of delays on product clearances on activity on Korea Units 3 and 4, Taiwan Units 5 and 6, the Philippines, Yugoslavia (KP.SKO), and Spain (Sayago and Alcarez unit.s). Uc've worked long and hard to become the world's largest and highest h,M cuality producer in our industry and feel we are being overlooked g D.J in the politics being playe{ in Washington on these issues. 4 fy' k N.
