MOTION TO COMPEL DEPOSITION , FOR SHORTENED TIME FOR RESPONSE , AND FOR LEAVE TO REPLY The Public Utilites Board of the City of Brownsville ,

Texas, pursuant to 10 C.F.R. 52.70(f), hereby requests the Atomic Safety and Licensing Board to order Central Power and Light Company ("CP&L") to produce Mr. R. W. Hardy for deposition during the week of February 25, 1980 in Abilene, Texas.

For several years , and until July,1979, Mr. Hardy was the Chairman of the Board and Chief Executive Officer of Central Power & Light Company.

Brownsville issued a Notice of Filing of Depositions on November 23, 1979, in accordance with 10 C.F.R. S2.740a, setting a December 13, 1979 date for Mr. Hardy's deposition .

This deposition was postponed at CP&L's request , on the basis of counsel's representation that Mr. Hardy's health would not permit deposition. In a letter dated December 12, 1979, (Attachment B) counsel for Brownsville offered to structure the deposition so as to accommodate Mr. Hardy, and requested a medical affidavit concerning Mr. Hardy's con-dition. Brownsville hoped to make arrangements to conduct this deposition during the week of January 14.

On January 9,1980, counsel for CP&L provided a one paragraph unnotarized letter dated December 26, 1979, which purports to be from one Carl M. Trussler , M.D.

(Attachment C) The letter described Mr. Hardy's ailment as

" accelerated renovascular hypertension." This explanation could cover a wide range of conditions, and is hardly suf-ficient to establish that there are no circumstances or arrangements under which Mr. Hardy could give a deposition.1/

CP&L has failed to substantiate its contention that Mr.

Hardy cannot under any circumstances be deposed. Brownsville accordingly, requests this Board to compel Mr. Hardy's depo-sition. Brownsville requests that February 8,1980 be set as the last day for CP&L's response , because of the short time remaining for discovery.

1/ On the contrary, to the extent that Mr. Hardy's health is uncertain and is likely only to get worse, this Board should be concerned with preserving his knowledge of CP&L's activi-ties throu-h a deposition taken in Abilene , Mr. Hardy's current residence , rather than during the course of an evi-dentiary hearir.g held in Bethesda , Maryland.

In the event that CP&L provides additional information on Mr.

Hardy's health by way of response to this Motion , Brownsville requests leave to reply up until February 15, 1980.

For the above reason, the Public Utilities Board of the City of Brownsville , Tbxas , respectfully request this Board to require Central Power & Light Company to produce Mr. R. W.

Hardy for deposition 'during the week of February 25, 1980, in Abilene, Tuxas, such deposition to be conditioned as appropriate if Central Power & Light makes a sufficient demonstration that such conditions are necessary to protect Mr. Hardy's health.
