SUMMARY

Investigative activity subsequent to the submission of the June 26, 1979 interim report regarding this matter was held in abeyance until a technical review of that report could be accomplished by the Division of Reactor Construction Inspection.

Based upon the results of that rev'ew, the Director, Division of Reactor Construction Inspection advised that no further investiga-tive effort was warranted.

DETAILS LETTER FROM MICHELSON Subsequent to the preparation of the June 26, 1979 report of investigation, Michelson furnished a copy of a June 13 1979 letter that he had written to Dr. Max Carbon, Chairman, Advisory Committee on Reactor Safeguards.

In this letter Michelsen provides Dr. Carbon his views regarding the sufficiency of either Part 21 or 10 CFR 50.55(e) to assure reporting of new, safety-related concepts or ideas. A copy of this letter is appended as enclosure (1).

INTERVIEW OF REQUESTOR The need for additional investigative effort was discussed jointly with Mr.

Harold Thornburg, Director, Division of Reactor Construction Inspection, the Requestor of this investigation, and Mr. Dudley Thompson, Acting Deputy Director, Office of Inspection and Enforcement.

Both agreed that no additional investi-gative effort was warranted and that any remaining questions such as the adequacy of the Part 21 procedures for B&W or TVA could be resolved by inspection activities rather than by an investigation.

STATUS OF INVESTIGATION This investigation is CLOSED. No further investigation will be conducted unless new infor=ation is developed in the course of the aforementioned inspection activities.
