Dear Parties:

It has come to the Staff's attertfrn that some confusion exists with regard to the " Status Report on the Evaluation of Licensee's Compliance with the NRC Order Dated August 9,1979," issued by the Staff on January ll,1980, and whether discovery on that document is to be completed within 30 days of service.

(The '.icensing Board, in its First Special Prehearing Conference Order, Decembu 18, 1979, Slip Op. at 66, ruled that discovery on the Staff's Safety Evaluation Report (SER) is to be completed within 30 days of issuance of the SER).

While the Staff had estimated that the SER on restart would be issued in January 1980, that estimate proved to be optimistic.

Consequently, because there remained a number of unresolved items, a number of areas in which information was due from the licensee, and a number of areas in which the Staff's evaluation was incomplete, the Staff was unable to issue its completed SER in January and, instead, issued the Status Report referenced above.

The Status Report is basically an SER outline and a report on the status of items being reviewed for restart, although it does contain substantive material and the Staff's evaluation in some areas of review and is subject to discovery.

However, we believe that discovery requests with regard to the Status Report vould be much more meaningful, efficient and appropriate if such requests were withheld until issuance of a more substantially completed SER.

The Staff, there-fore, suggests that any discovery requests on the Status Report be filed along with discovery during the 30-day discovery period following service of the more substantially complete SER.
