20036 Re:
The Toledo Edison Company (Davis-Besse Nuclear Power Station, Units 2 and 3)
Docket Nos. 50-500 and 50-501
Dear Mr. Silberg:
This will refer to your January 24, 1980 letter to Mr. Rosenthal, advising that the co-owners of pro-posed Units 2 and 3 of the Davis-Besse facility have decided not to construct those units.
In light of that development, your letter requested "that the Atomic Safety and Licensing Appeal Board terminate any further proceedings in these dockets".
As Mr. Rosenthal advised you by telephone upon his receipt of the letter, no action will be taken on your request pending further word respecting whether the co-owners intend to withdraw their application for construction permits (or, instead, will pursue some other course).
It is Mr. Rosenthal's understanding that, once a determination in this regard has been made, you will promptly so inform him.
It is his further understanding that, because of the pendency of petitions for Commission review of ALAB-560 (in-volving, inter alia, Units 2 and"3 of Davis-Besse),
your firm w.ill also provide that information directly to the Commissioners.
Sincerely, C-N 1952 172 C.
