Dear Mr. Cochran:

This is in partial response to your letter dated December 7,1979, in which you requested, pursuant to the Freedom of Information Act, all infonction related to construction of a gas centrifuge enrichment plant by Pakistan and negotiations regarding Pakistan's efforts to acquire nuclear weapons-useable material or nuclear explosive devices.

A memorandum dated November 21, 1979, from Edward J. Hanrahan to Chairman Hendrie, et al, regarding Control Review Procedures for Exports to Pakistan, contains information classified pursuant to Executive Order 12065. This information is being withheld from public disclosure pursuant to Exemption (1) of the Freedom of Information Act (5 U.S.C. 552(b)(1))

and 10 CFR 9.5(a)(1).

Pursuant to 10 CFR 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its producticn or disclosuis is contrary to the public interest. The person responsible for this denial is Edward J.

Hanrahan, Director, Office of Policy Evaluation.

This denial may be appealed to the Commission within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the Secretary of the Commission, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."

Other documents subject to your request were originated by the Department of State (DOS) and have been referred to DOS for review and direct response to you.
