S. Nuclear Regulatory Commission Mr. Victor Stello, Jr., Director Office of Inspection and Enforcement Washington, DC 20555 Gentlemen:

UNC Resources has decided, after careful review, to pay the reduced fine proposed by the Commission in your Janu-ary 6, 1980 letter.

The Company's decision is based upon these factors:

1.

UNC's response to the original citation, dated September 14, 1979, set forth the Company's position in some detail; that position has not changed.

Although we continue to believe that we are not guilty of a fineable offense, further discourse does not appear appropriate or promising.

2.

We understand that the government plans no further enforcement action in this matter.

3.

The cost-benefit outlock for any further appeal is discouraging, based upon legal costs already experienced in thic matter.

Although this penalty is paid under protest, UNC remains committed to its policy of full compliance with regula-tory requirements.

However, these requirements have now reached a stage where our continued operation is probably no longer economically feasible.
