January 17, 1980 Docket No. 50-346 Mr. Terry J. Lodge, Chairman TCSE Legal Action Committee P. O. Box 4545 Toledo, Ohio 43620
Dear Mr. Lodge:
In my letter to you dated June 27, 1979, I indicated that a portion of your petition on behalf of the Toledo Coalition for Safe Energy had been separated out for treatment under 10 CFR 2.206 and that the remainder had been forwarded to the Secretary cf the Commission for docketing as a petition for rulemaking.
I have considered the subject matters addressec in your petition pursuant to 10 CFR 2.206 to modify the operating licer.se of the Davis-Besse plant.
At the present time the Davis-Besse Emerger.cy Plan eets current regulatory requirements.
However, the Nuclear Regulatory Comission is taking immediate steps to upgrade the emergency plar.s for all operating nuclear power plants, including Davis-Besse.
On tr.is basis, I have concluded that the institution of proceedings to modify t1e operating license for Davis-Besse and to hold public hearings on this natter are not called for.
A discussion of the actions being taken by the NRC and the reasons for this decision are enclosed.
Also enclosed is a copy of the notice that is being filed with the Office of the Federal Register for publication.
Sincerely, pr $ $
k Harold R. Centon, Director Office of huclear Reactor Regulaticn
