ORDER (January 25, 1980)

The Applicants, by letter dated January 24, 1980, have asked for the same extension of time within which to file a motion to compel discovery pursuant to 10 CFR 52.740(f) against CEU as we yesterday granted the Staff.

We agree with the Applicants' inter-pretation of 10 CFR 52.740(f) as permitting the usual 5-day mailing period (10 CFR S2.710) to be taken into account.

But we acknowledge that the strict wording of 52.740(f) does not necessarily lead to that result.

To avoid any ambiguity, and good cause having been demonstrated, the Applicants are granted an extension of time to and including January 29, 1980 to file a motion to compel discovery against CEU.

IT IS SO ORDERED.
