UNIT 1 - APPLICATION FOD, EXTENSION OF CONSTRUCTION PERMIT COM2LETION DATE

Dear Mr. Denton:

The Cincinnati Gas & Electric Company, Columbus and Southern Ohio Electric Company and The Dayton Power and Light Company (" Applicants") hereby request that, pursuant to Section 185 of The Atomic Energy Act of 1954, as amended, and the Regulations of the Nuclear Regulatory Commission ("NRC" or

" Commission"), particularly 10 C.F.R. 50.55(b), the latest completion date of April 1, 1980 specified in Construction Permit No. CPPR-88, as amended on June 1, 1977 (43 Fed. Reg. 30697:

June 16, 1977) be extended to November 30, 1981.

Construction of the Zimmer Station, which is presently approximately 94.5% complete, cannot be expected to be completed and an Operating License issued by April 1, 1980 due to circum-stances beyond the control of the Applicants, primarily the effect of the accident at the Three Mile Island Nuclear Station, Unit 2 which has virtually brought the NRC licensing process to a halt.

As you are aware, the Commission has not yet completed its own evaluations of this matter nor reviewed the various ongoing out-side investigations of the accident. It appears that a broad spectrum of new, but as yet undefined, additional requirements will be imposed on licensees and substantial delays in licensing will occur. Even after the Commission has established all criteria for resumption of licensing and the Staff is satisfied with the Applicant's implementation of the NRC's new requirements, hearings before an Atomic Safety and Licensing Board will have to take place and the Commission's new review procedures completed prior to the issuance of any operating license for the Zimmer Station.

Zimmer Nuclear Power Station - Page #2 Unit 1 - Application for Extension of Construction Permit Completion Date The length of the extension request is based upon the statement of the then Chairman of the NRC, Dr. Joseph Hendrie, to the House Energy and Power Subcommittee last November that there could be up to a two year period during which no licenses would be issued. While we certainly hope that licensing will resume well before that time, and we are committed to cooperating fully with the NRC to expedite the issuance of an operating license for the Zimmer Station, we have chosen to request an extension until November, 1981 to avoid having to request further extensions of the construction permit.

Since the requested extension of the construction permit involves no significant hazards consideration and no undue risk to the health and safety of the public, it is requested that the Commission dispense with the notice and publication requireme':ts as permitted under Section 189(a) of the Atomic Energy Act of 1954.
