Dear Mr. Eizenstat:
This responds to your memorandum of November 2,1979 in which you urge the Nuclear Regulatory Comission to expedite promulgation of final regulations to implement section 504 of the Rehabilitation Act.
Following the January 13, 1978 publication by HEW (now the Department of Health and Human Services) of procedures, standards and guidelines for implementation of section 504 by Federal agencies, the NRC staff experienced a sharp increase in workload relating to civil rights matters. Moreover, the complexity of several legal issues relating to the interpretation and application of section 504 to the limited NRC-sponsored programs which are covered by the statute required continuing consultation between NRC staff and the Office of General Counsel at HEW.
The proposed NRC regulations to implement section 504 were published on May 8,1979 for public comment. These regulations were in accordance with the HEW guidelines. Numerous comments from members of the public were received; evaluation of these comments is near completion.
It is anticipated that the final regulations will be forwarded to the Comission for approval in December,1979.
