Dear Mr. Stachon:

On September 18, 1979 the Commission extended the time for consideration of petitions to review the decision of the Atomic Safety and Licensing Appeal Board in the subject case.

That time period has elapsed.

A majority of the Commission not having exercised its discretion to take review as provided in 10 CFR 2.286, your petition is deemed denied under Section (b) (5) thereof.

Commissioners Gilinsky and Bradford, who dissented, have requested that you be advised of their views as follows:

"It seems sensible to us to consider the subject ALAB together with the question of the standing of the Indian Tribe to intervene in this case, which is currently being revieJed by OGC in the context of a separate ALAB..For chat reason, we should suggest that the time be extended on the subject paper to expire concurrently with the decision on whether or not to review the standing of the Indian Tribes."
