Dear Mr. Scott:
I have received your letter dated October 10, 1979, wherein you assert that some unidentified member of Applicant's law finn discussed scheduling matters with me sometime in January, 1979.
I have no recollection of this purported discussion upon such procedural matters.
I have concluded that this discussion did not take place because, in the first place, my records do not memorialize this discussion. Second, the Board's Order of November 30, 1978, had denied without prejudice Appli-cant's Motion For Order Establishing Schedule submitted on November 18, 1978 as being premature. Therein the Board specifically stated that " Consideration will be given to the proposed timetable for scheduling after the Board rules upon the admission of parties".
(Underscoring added). As you are aware, the Board did not rule upon the admission of parties until it issued the Order Ruling Upon Intervention Petitions dated February 9,1979.
Subsequent to February 9,1979, two conference calls were placed by Applicant on February 15, 1979. At the time of the initial call, since you and Mr. Lowerre were not available, I requested that Mr. Newman, Applicant's ccunsel, place the call later that afternoon. Again, at the time of the second conference call, you were unavailable. During the second call, I discussed certain schedul-ing matters with Dr. Cheatum, Applicant's attorneys, the Staff, Mr. Lcwerre, Ms.
Hinderstein, Ms. McCorkle and Mr. Shreffler. The Board's Order of February 16, 1979 reflected the Board's ruling upon scheduling and a copy thereof was served upon you.
Further, pursuant to my request made during the second February 15th conference call, Applicant's counsel, Mr. Copeland, sent you a letter on February 16, 1979 which set forth my statements expressed during that conference call.
