Thank you for your letter of September 10, 1979, in response to our letter dated September 6, 1979, with an enclosure. Based on your letter we will expect Nuclear Assurance Corporation to respond to the findings identified in our report 99900331/79-01.

Because Nuclear Assurance Corporation is not in a position to address corrective and preventative measures relative to the Excelco Quality Assurance Program, these items will remain open in our files. Should you in the future undertake the manufacture of any casks other than those specifically identified in report 99900331/79-01, we will perform additional inspections of your facility and address the generic character of the problems identified in our report at that time.

With respect to your comment regarding ASME code applicability, we note that certain parts of the ASME Code were very definitely a contract requirement.

This was acknowledged in your letter to us dated May 11, 1978.

Since Nuclear Assurance Company has assumed responsibility for the corrective action concerning the specific casks in question, no response to this letter is necessary.
