Docket No. 50-312 We are enclosing our check in the amount of $4,000 in payment of the fee required for the application for amendment to facility license No. DPR-54 which we filed with the Division of Operating Reactors by letter dated October 3, 1979 and which is identified as Proposed Amend-ment No. 65 for Rancho Seco Nuclear Generating Station, Unit No. 1.
A copy of the letter is attached.
The enclosed license fee is paid under protest since a lawsuit is on file in the United States Court of Appeal for the 5th Circuit (Mississippi Power & Light Co., et al. vs. United States Nuclear Regulatory Com-mission, et al.
Civ. No. 78-1565) to obtain review of the validity of those rules.
