Dear Mr. Chairman:
Enclosed for the information of the Subcommittee on Nuclear Regulation is a notice of proposed rule making that completes implementation of certain provisions of Public Law 94-197, legislation enacted on December 31, 1975, which modified and extended to August 1,1987 the Price-Anderson Act (P.L.85-256).
This proposed rule will codify in 10 CFR Part 140, a standard master policy form which the Comission determines to be adequate proof that a licensee is maintaining the necessary secondary financial protection required by the Commission pursuant to subsection 170b. of the Atomic Energy Act of 1954, as amended.
Since August 1, 1977, the Commission has utilized a binder furnished by the two nuclear liability insurance pools, Nuclear Energy Liability-Property Insurance Association and Mutual Atomic Energy Liability Underwriters, as evidence of secor.dary financial protection.
In the staff's view, the standard master policy form submitted by the insurance pools meets all the requirements for implementation of P.L.94-197.
The proposed rule making is to solicit public comments on the policy.
