(February 27, 1979)
The Appeal Board, by its Decision dated February 26,1979 (AIAB-528),
remanded the PIRG petition for leave to intervene to the Licensing Board with instructions to grant the petition.
It further provided that PIRG's participation in the proceeding shall be consolidated with that of Intervenor Carolina Action, in accordance with the provisions of 10 CFR 2.714(e) and 2.715a.
In accordance with these instructions upon renand, PIRG's petition for leave to intervene is granted and its stated contention is held admissible as a contention at this stage of the proceedings. PIRG's participation is consolidated with that of Intervenor Carolina Action, under the provisions of 10 CFR 2.714(e) and 2.715a.
Such participation shall be consistent with the terms of our Order Concerning Discovery, Contentions and Sch-b1 Ng, dated February 23, 1979.
It further appears that PIRG is now being represented by a different individual than the chairperson (Charles Gaddy) Sho signed and filed 7903130 503
1 the original petition for leave to intervene. As the Appeal Board observed, the status of this new representative in the organization is unclear. Accordingly, PIRG is directed to duly verify the status of its purported representative and the authorization to act in its behalf in thisproceeding.1/
