Dear Congressman Burton:

Thank you for your letter of December 7,1978, conveying two statements from Gerald K. Rhode, Vice President of Niagara Mohawk Power Corporation and Chairman of the Electric Utility Companies' Ad Hoc Nuclear Trans-portation Group.

The NRC staff is aware of Mr. Rhode's two statements and is considering the suggestions made in each of them.

We had received previously from Mr. Rhode a copy of his speech before the 1978 Annual Conference of the Atomic Industrial Forum. A copy of our reply to his letter is enclosed.

It indicates that his suggestions are presently under consideration.

The otner statement, enclosed with your letter, is essentially a conden-sation of the speech with emphasis on designating a lead Federal, agency to define and coordinate the roles of Federal and State agencifs, local authorities, carriers, and shippers in emergency response planning and actual responses for transportation accidents involving radioactive materials.

We agree with the advisability of defining and clarifying the respective responsibilities of the governmental agencies working in this area and we are presently updating our Memorandum of Understanding with the Department of Transportation with respect to the investigation of transportation incidents involving NRC-licensed material.

Although not expressed explicitly, we believe that Mr. Rhode makes three major recommendations in his two papers with respect to emergency plan-ning for the transportation of radioactive materials. These recommenda-tions and our comments are enclosed, along with some other information which may be helpful to you.

The staff plans to meet with representatives of the Electric Utility Companies' Nuclear Transportation Group to discuss the group's recommenda-tions concerning emergency planning for transportation of radioactive materials.
