Dear Congrensman O'Brien:

Rcierence is made to your letter to ?.:r Carlton Dmmerer, drted January 19, 1979 relative to the petition for leave to intervene filed by Bridget L. Rorem et al., in the matter of Commonwealth Edison Company (Braidwood Nuclear Power Station) STN 50-456 and STN 50-457.

On January 29, 1979 the NRC Staff filed an answer to the petition of Bridget L. Rorem et al. (copy attached) wherein the Staff recommended that the Atomic Safety and Licensing Boat-d find that the petitioners have satisfied the requirements of 10 CFR S2.714 with respect to standing, but that since petitioners may submit contentions with required specificity of 10 CFR $2.714(b) at any time up to 15 days prior to the holding of the first prehearing conference it is premature for the Board to rule now on the adequacy of the petition as a v hole at this time.

The usual practice would be for the Board to set a date for a prehearing conference in the near future at which time the applicant, staff and petitioners will present their views with respect to intervention petitions and conformance with requirements of 10 CFR $2.714.

We will place your name on our service list, so that you will receive copies of all documents served on the Board and parties.
