BILL OF EXCEPTIONS
'co On November 30, 1978, the Atomic Safety and Licensing Board issued a Memorandum and Order denying the Motion for Modification of the Licensing Board's August 14, 1978, and September 1,1978, Orders Re: Limitation on Contentions filed by Texas Public Interest Research Group (Tex PIRG).
On December 7,1978, Tex PIRG filed with the Licensing Board a Bill of Exceptions related to the Board's Order.
Section 2.771 of 10 CFR contains provisions for petitions for reconsideration of a final decision.
Petitioner Tex PIRG seems to be petitioning for reconsideration since the pleading is filed with the Licensing Board and not with the Appeal Board; and no brief has been filed as required in 10CFR52.762.3 The Staff opposes this reconsideration.
sit is not necessary under NRC practice to file a Bill of Exceptions to preserve matters for appeal.

Tex PIRG states that in its view the Board erred in its Memorandum and Order for four reasons, namely, that res judicata and/or collateral estoppel are not applicable; there har been no showing of delay or prejudice; public interests require Tex PIRG's request; and the "new evidence" restriction violates the Appeal Board decision of December,1975.
The Staff believes Tex PIRG's request for reconsideration is without merit and should be denied.
No basis for reconsideration is given.
Alleged errors are merely set out without any indication of why it is believed these are errors.
Neither res judicata nor collateral estoppel has been proffered as legal basis for denying a de novo proceeding four years after the notice of hearing.
The significant issue in this matter is that the Petitioner has not set forth sufficient basis to show good cause for such an extremely late petition to intervene. The burden of sub-stantiating ;ood cause for late filing is on the petitioner and not the Board, Staff or Applicarl as Tex PIRG seems to believe. The Petitioner also fails to show why the public interest requires admission of such untimely intervention. As to the previous finding of the Appeal Board concerning the partial initial decision of 1975, the Petitioner misconstrues the Board's holding that the previous decision could be reconsidered if new information became available, to mean that any issues not decided in 1975 would be subject to a new opportunity for intervention.
Certainly this is a distortion of the Appeal Board's statements, and cannot be supported.
. The Staff believes the Tex PIRG Bill of Exceptions should be denied as inadequate bases for reconsideration of the Board's Order.
