Dear Mr. Chairman,
This is a request under the Freedom of Information Act as amended (5 U.S.C. 8 552).
I request the following documents:
(1)
All NRC Inspection Reports concerning an inspection of Vallecitos facilities September 25-28.
These reports include a report apparently numbered 70-754/7808.
(2)
Any Notices of Violation' filed as a result of the above-referenced inspections.
If you determine that some or all of the material is exempt from release, I would appreciate your advising me as to which exemption (s) you believe covers the material which you are not releasing.
I am prepared to pay reasonable costs for locating and reproducing the requested documents.
As you know, the amended Act permits you to waive the fees if it "is in the public interest because furnishing the information can be considered as primarily benefitting the public."
I believe that this request plainly fits that category and ask you to waive any fees.
If you have any questions regarding this request, please telephone me at the above number.
As provided for in the amended Act, I will expect to receive a reply within ten working days.
I apologize for invoking the provisions of the F.O.I.A.
This request, however, is my third request for these documents.
