Pursuant to the initial decision of the Atomic Safety &

Licensing Board dated December 26, 1978, the Director of IIuclear Reactor Regulation has been authorized to issue the construction permits listed in the caption above. There is delivered herewith the check of Long Island Lighting Company in the amount of

$975,800.00 representing the construction license fee listed in your invoice dated January 2, 1979 Will you kindly issue the construction license to the bearer of this letter.

The payment of the foregoing license fee is made under protest and shall not be deemed a waiver of applicant's rights to seek a refund upon the ground that such fee is an unconstitutional tax upon the applicant and that the lluclear Regulatory Commission has acted unreasonably and beyond its authority in computing and imposing such fee.
