Dear Mr. Denton:
On April 27, 1971, the Ccmnission issued an Order for flodification of License with rer,pect to Indian Point Nuclear Generating Unit No. 2. That Order modified Facility Operating License No. DPR-26 by adding the following new provisions:
(1) As socn as possible, the licensee shall subnit a reevaluation of ECCS cooling performance calculated in accordance with the Westinghouse Evaluation bbdel, approved by the NFC staff and corrected for the errors describal herein.
(2) Until further authorization by the Ctmnission, the Technical J

the facility shall be limited to 2.24.
In accordance with and in satisfaction of the above license provisions, Consolidated Edison Carpany of New York, Inc. (" Consolidated Edison")
has consulted with Westinghouse, the nuclear steam systen supplier, and a reanalysis of the Indian Point Unit No. 2 Emergency Core Cooling Systen (DOCS) has been performed using the February 1978 Westinghouse Evaluation bbdel. This Model has been approved by the NFC Regulatory Staff and the analysis incorporates, as required, correction for the errors describcd in the April 27,197E Order.
Consolidated Edison transmits herewith forty-three (43) copies of the Indian Point Unit No. 210CS reanalysis document entitled, " Analysis of the Dnergency Core Cooling Systan in Accordance with the Acceptance Criteria of 10 CFR 50.46 and Appendix K of 10 CFR 50", dated Decenber, 1978. In addition, transmitted herewith are three (3) originals and forty (40) copies of a related " Application for Amendment to Operating License," sworn to on January 3, 1979. This Application requests an amendment to the Indian Point Unit No. 2 Technical Specifications to revise the required accumulator tank volume and the limit for total nuclear peaking factor (F ) to those values used in the enclosed EOCS g
reanalysis.

. Consolidated Edison and its vendor are available to meet with you or manters of the Regulatory Staff, if necessary, to review the Indian Point Unit No. 2 ECCS reanlaysis. Upon acceptance by the Staff and issuance of the appropriate technical specification modifications, it is assumod that appropriate action will be taken to vacate the special April 27, 1978 license provisions quoted above.
Finally, in accordance with 10 CFR 170.22, this Application has been determined to be CIASS III, as it involves a single issue and has been deemed not to involve a singificant hazards consideration. Therefore, as requircxl by regulation, enclosed is a check in the amount of $4,000.00 as the filing fee. This payment is being made under protest, and Con Edison reserves the right to challenge the validity of the imposition of these fees and the basis for the determination of the amounts of the fees.
