ORDER DENYI:01DTION 10 QUASH IEICE OF DEPOSITION OF S. B. PHILLIPS, JR.
(January 15, 1980)
On DeceSer 21, 1979, Central and South West Corocration (CSW) fileo a motion to quash the notice of deposition directed to S. B. Phillips, Jr., its chairan of the board and chief executive officer.
Tne Public Utilities Board of the C4 ty of Brownsville, Texas (Brownsville), which had previously noticed this deposition, filed its response in opposition on December 28, 1979.
The principal grounds for the notion to quash involve the assertion that Mr. Phillips' deposition would be cu:nalative of the testirony of other witnesses.
This is insufficient reason to bar a deposition. A party is entitled to e>; lore relevant facts with each person who has knowledge of such facts.
This is a proper function of discovery.
The notion to quash is denied, and CSW is directed to produce the.w'eness for deposition promtly upon a mutually agreeable date.
