ORDER DISMISSING PROCEEDING The Missouri Public Service Commission (MPSC), uhich had been the only petitioner for leave to intervene, filed a document, dated December 21, 1979, stating that it has no intention of amending its 10 C.F.R. 5 2.715(c) petition, so as to intervene as a 5 2.714 party, or to raise any specific aspect upon which a hearing should be held.

It intervened as an interested State, because of its jurisdiction over Kansas City Power & Light Company, a one-half owner of the Wolf Creek facility, solely for the purpose of being placed on the service list and receiving all documents in the matter before the Board.

This clarification of MPSC's intervention removes the' need and occasion for evidentiary hearings, since there is no issue to be heard by the Board.

Dismissal of this proceeding would be consistent with the Commission's requirements which do not 1825 311 POo fC8 0 4-6 T contemplate a hearing on an application for an amendment to a con-struction permit in the absence of any matters in controversy or any requests for hearing by interested persons, 10 C.F.R.

SS 2.104, 2.105, 2.714 and 50.58(b), and would be consistent with the general powers of the presiding officer under 10 C.F.R. 5 2.718.

It is ordered that this proceeding which was begun with the establishment of the Atomic Safety & Licensing Board on November 14, 1979, as published at 44 Fed. Reg. 66716 (Nov. 20, 1979), is hereby dismissed.
