Dear Mr. Monroe:

This is in response to your letter of September 26, 1979 in which you requested, pursuant to the Freedom of Information Act, a copy of the winning proposal submitted by Teknekron Research, Inc. in response to contract solicitation NRC RFP No. RS-0IE-79-254 entitled " Evaluation of NRC's Revised Inspection Program," a copy of the resulting contract and other information regarding the above-referenced solicitation.

The evaluation plan developed by the evaluating committee prior to the receipt and evaluation of the competing proposals which you have requested, has been previously made available to all offerors, including to your company, who responded to the solicitation.

Pursuant to a telephone conversation of November 19, 1979 between Jacob H. Zamansky of my staff and Ms. Virginia A. Lee, your Contracts Administrator, Ms. Lee agreed to accept a non-proprietary version of the winning technical proposal.

Enclosed is a copy of the non-proprietary version of the winning technical proposal and a copy of the contract.

The evaluation committee's final report contains predecisional deliberative material provided as part of the decision making process in the awarding of a contract. As this report contains advice, opinions, and recommendations of the staff, portions of it are being withheld from public disclosure pursuant to Exemption (5) of the Freedom of Information Act (5 U.S.C.

552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations.

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest.

The persons responsible for this denial are the undersigned and Mr. Edward Halman, Director, Division of Contracts.

This denial may be appealed to the Commission's Executive Director for Operations within 30 days from the receipt of this letter.

As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is in " Appeal from an Initial F0IA Decision."
