Applicant responds to the inquiries forwarded by letter of December 27, 1979, as follows: (1) The document entitled " Assessment of BWR Mitigation of ATWS (NU PE G-0 4 60 Alternate No. 3) , May, 1979," is the document that Applicant and Mr. Doherty agreed should be the subject of the Protective Order. (2) This document was not developed by General Electric Company specifically in response to Interrogatory 1 of Doherty's First Set of Interrogatories, but it is_ responsive to the question asked. (3) This document does not " bear" a NUREG number, but only references the Staf f document used as a parametric guide for the analysis which is contained in the named GE document. The analysis assumes the implementation of the systems and procedures outlined as Alternate No. 3 in Vol. 3 of NUREG-0460, December, 1978.

Applicant's counsel has consulted with Mr. Doherty and has been authorized by Mr. Doherty to represent to this 8001250 ON

BAKER & BoTTS Page 2 January 11, 1980 Board that the aforementioned document has been accurately cited and is the actual document to be covered by~the protective order.

Subsequent to the filing of Applicant's Motion for Protective Order on October 22, 1979, General Electric Company published a supplement to the aforementioncd document entitled " Assessment of BWR Mitigation of ATWS Volume II (NUREG-04 60 Alternate No. 3) , December, 1979." Since this supplement is now part of the document in question, it would be appropriate to make certain that it is covered by the protective order. Accordingly, Applicant requests the Board to amend the Protective Order by changing all references to

" document" to " documents" and by altering the first ordering paragraph to read as follows:

WHE REFORE , IT IS ORDERED that the document entitled " Assessment of BWR Mitigation of ATWS (NUREG-0460 Alternate No. 3) May, 1979," all supplements and amendments thereto, and the information contained therein, shall be accorded confidential treatment and subject to the following restrictions:

The Applicant has no other comments on the proposed modification of the order issued by the Board on November 7, 1979.
