NRC-19-80-470 ARTICLE I - STATEMENT OF WORK BACKG10UND In connection with the application for export of the Philippine reactor (PNPP-1), Office of Policy Evaluation performed a review last summer of seismic hazards for the PNPP-1 site (with substantial support by consultant Dr. John Kelleher of Woodward, Clyde Consultants and NRC's Geosciences Branch) 3 and as follow-on task, Chairman Ahearne has requested that OPE (have Dr. Kelleher) i review and assess the reports of two geoscientist consultants to the PUNO Commission, which performed a major review of safety and other factors for the PNPP-1 reactor on behalf of the Philippine Government.

WORK SCOPE Contractor shall review and assess the reports to the PUNO Commission on seismic and related hazards performed by Drs. Stepp and Lemnitz and the work shall be conducted within NRC offices and it is anticipated that two man-days of effort shall be required. The Contractor shall submit a written report with his findings. The report shall be submitted to NRC on or about January 11, 1930.

ARTICLE II - PER100 0F PERFORMANCE The period of performance shall ccmmence on January 8, 1950 and all work including the final report shall be ccmpleted by January 11, 1980.

ARTICLE III - CONSIDERATION In full consideration of the Contractor's performance hereunder, NRC shall pay the Contractor the fixed rate of four hundred forty ($440.00) dollars per day estimated at two (2) man-days. The Contractor will be reimoursed for all travel as described below, incurred directly and specifically in the performance of this contract, claimed by the Contractor, and accepted by the Centracting Officer.

1.

Per dien shall be reimbursed at a daily rate net to exceed.$50.00.

The per diem amount is comprised of lodging expense plus $20.00 for meals and miscellaneous expense.

2.

When travel is to one of the high ate geographical areas listed below, actual subsistence costs shall be reimbursed at a daily rate not to exceed tSe rates indicated:

The cost of travel by privately owned automobile shall be reimbursed at the rate of 181/2d per mile.

4.

The cost of travel by rente.d automobile shall be reimbursed on a ceasonable actual expen:e basis.

5.

All common carrier travel reimbursable hereunder shall be via economy class rates when available. If not available, reimburse-ment vouchers will be annotated that economy class accommodatic,ns were'not available.

First class air travel is not authorized.

6.

Receipts are required for common carrier transportation, ledging and miscellaneous items in excess of $15.00.

ARTICLE IV - PAYMENT Payment shall be made in accordance with Clause 2 of the General Provisions entitled " Payment" as soon as practicable after completion and acceptance of all of the work, upon submission by the Contractor of vo'ucher(s} in a form satisfactory to the Contracting Officer, provided, however, that said parlent(s) shall not be deemed to prejudice any rights which the Government may have by law cr under other provisions of this contract.

Perfor ance of the work hereunder shall be subject to the technical instructions issued by the US Tiuclear Regulatory Comissicn. The technical instructions shall be signed by the COAR.

The COAR is responsible for:

1.

monitoring the Ccntractcr's technical progress, includi.g the sur-veillance and assessment of perfor~ance and rec:mmending to the

.'ontracting Officer changes in requirement; 2.

interpreting the statement of work; 3.

performing technicsl evaluation as required; 4.

perfor :ing the technical inspection: and acceptances required by this contract; and 5.

assisting the Contrac:cr in the resoluticn of technical problems encoun ered during perfce:ance.

Contracting Officer is responsible for directing or negotiating any changes in terms, conditions, or amounts cited in the contract.

For guidance frem the COAR to the Contract:r to be valid, it must:

1.

be censistent with the description of work set forth in this contract; not constitute new assignment of work or change of the expressed 2.

terns, conditions, or specifications incorporated into this contract; I

3.

not constitute a basis for an extension to the pericd of perfor-ance 1

or contract delivery schedule; and 4.

not con:titute a basis for any increase in the centract prica.

I If the Contractor receives guidance from the COAR which the Centractor feels is not valid under the criteria cited above, the Contractor shall immediately notify the COAR.

If the COAR and the Contractor are not able to resolve the questions within five days, the Contractor shall notify the Centracting Officer.

The Centractor shall not publish, permit to be published, er distribute for public consumptica any infor-ation cral or written, concernic; the results or conclusions made pursuant to the performance of this contract, without '_he prior written consent of the Contracting Officer.
