Gentlemen:

During the course of the evidentiary hearing before this Licensing Board in the above remand proceeding, some questioning occurred regarding the extent to which lawyers could appropriately participate in the preparation of a witness's written testimony filed

! in advance of hearing, and also could thereafter properly prepare I that witness for anticipated cross-examination.

In light of this interrogation, we formally requested an opinion on these matters from the Legal Ethics Committee of the District of Columbia Bar, since it seemed to us that the subject was one of general professional interest which deserved official Committee 1796 017 8001240 J
