Dear Mr. Keppler:

In accordance with the provisions of Section 2.201 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, Public Service Company of Indiana, Inc. (PSI) offers the following information in response to the item of noncompliance identified in Inspection Report No. 50-546/79-23; 50-547/79-23.

Item of Noncompliance:

PSI procedures (No. PP-29 and LAP 2) for the control of NRC Bulletins and Circulars were inadequate regarding control of these bulletins and circulars which do not require a written response to NRC.

Corrective Action Taken and Results Achieved:

The Nuclear Safety and Licensing Group (NSLG) of Project Engineering has sent to either its architect - engineer (Sargent & Lundy), equipment vendors, or PSI personnel for evaluation all NRC IE Bulletins and Circulars which PSI has received to date but was not required to respond by letter to the NRC. These parties have been directed to evaluate these documents for applicability to Marble Hill and to provide the results of their evaluation to the Nuclear Safety and Licensing Group by appropriate documentation. Based upon these results, the NSLG will forward all pertinent documentation to the appropriate PSI personnel for their information. To date, several evaluations have been returned and others are being received daily.

Bulletin 78-14 and Circulars 78-04, 78-05, 78-13, 78-16 and 78-19 are still undergoing evaluation. Circular 78-06, dated 5-25-78, was not received by PSI.

The listing of this circular in our Document Index was incorrect and the actual correspondence received was Bulletin 78-06, dated 5-31-78.

. During the subject inspection, the Licensing Section was requested to back-date its logs to include all bulletins and circulars received by PSI to date. This was performed as of December 17, 1979. In addition, the Licensing Administrative Procedure #2, Rev. O, for the handling of NRC IE Bulletins and Circulars will be approved for use by January 15,1980.

Corrective Action Taken to Avoid Further Noncompliance:

g g 5 Future noncompliance will be avoided by revising existing Project Procedure #29 e for the handling of IE Bulletins and Circulars by Project Engineering. All bulletins and circulars, whether a formal written response to the NRC is required or not, will be evaluated and handled in a similar manner.

Date When Full Compliance Will Be Achieved:

The revised Project Procedure #29 was approved for use as of December 17, 1979.

Evaluations of previously unevaluated bulletins and circulars will be completed by March 31,1980.

As previously stated, all of the Licensing Section logs were back-dated as of December 17, 1979. Also, the Licensing Administrative Procedure #2 will be approved for use by January 15,1980.
