-- He talked to Mattson who says Thadani analyzed it and it is not a problem.
-- Lanning got the report from Bill Johnston.
-- Lanning says Thadani says he got the report from Westinghouse when he asked if they had ever had a similar transient. They said that this was the only one.

-- He is highly disturbed that the NRC didn't know about this until now.
-- Concerns:
o The ECCS at Beznau uses a coincident logic that requires both low pzr level and low pzr pressure to initiate Safety Injection. During this transient pzr level didn't decrease so SI didn't initiate until about 11 minutes into the event and after the relief valve blocking valve had been shut.
o There is strong indication that the PORV passed water.
o All U.S. Westinghouse designs had the same coincident ECCS logic.

-- Beznau had some cavitation and two phase flow but Thadani doesn't think that was due to a loss of cooling capability.
-- Thadani has been working with Howard Faulkner of IP.
-- Thadani found out about the incident after TMI when he asked Westinghouse if they had ever had a PORV stick open. Their response was "not in this country." When he pursued the issue he found out about Beznau.
One problem with this matter is that the report is classified in Switzerland.
-- His opinion is that the mattar should have been reported by Wes+inghouse.
-- Mattson wanted to release the report immediately but Case has been holding it up because of the Swiss classification.
-- Thadani's contact at Westinghouse has been Tom Anderson.

- There are two reports, one by Westinghouse and one by the Swiss.
I have the Westinghouse report.
He asked that I get the Swiss report from whoever gave me the Westinghouse report.
- IP tracked down the reports.
Thadani only knew that it was a Westinghouse plant in Switzerland. Both reports came from the Swiss utility thru the Swiss government after TMI.
- We have an agreement to exchange information with the Swiss but it didn't take effect until December 9,1974. (The incident occurred in August 1974 and the Westinghouse report is dated Septenter 1974).
- IP conducted a library search and could not find any public reference to the incident or the reports.
- The reports are not classified.
They are considered proprietary by the utility.
I got the impression that the proprietary issue is mostly a matter of embarassment about not reporting the incident sooner. We (NRC) have agreed to maintain the confidentially of the reports. We can refer to the general nature of the incident but not the name of the plant or country involved.

- Part 21 may apply to foreign reactors if it involves the safety of US reactors. But Part 21 didn't become effective until August 10, 1977. He doesn't know if there's a backfit provision.

- If a high level official became aware of an incident, he must report it regardless of when the event actually occurred.
- He'll send a cnpy of NUREG 0302 to me.
- Statute says retsponsible officers (zVP) must report.
Regul ation says they must have a procedure to move information up to the responsible officer. Statute definitely applies to non-licensees.
The regulation may or may not apply to non-licensees.
- Bill Russell is the " expert" on Part 21 in NRR.
