Dear Mr. Kacmarik:
I am writing in response to your attached letter of December 26,1979 to the U. S. Nuclear Regulatory Commission requesting denial of the construction permit extension application for the Bailly Generating Station, Nuclear-1.
On November 30, 1979, a " Notice of Opportunity for Hearing on Construction Permit Extension" was published in the Federal Register (44 F.R. 69061). I am enclosing a copy of this Not:ce for your information. The Notice provided an opportunity for any person whose interest might be affected by the proceeding to request a hearing in the form of a petition for leave to intervene, filed pursuant to 10 C.F.R. 52.714 of the Commission's regulations, no later than December 31, 1979. It does not appear from the form or substance of your December 26 letter, which does not address the pertinent requirements of 10 C.F.R. 52.714, that you intend it to serve as an intervention petition and it has not been treated as such by the NRC Staff. Petitions to intervene have been received from several individuals and organizations in this matter. An Atomic Safety and Licensing Board has been designated to rule on the intervention petitions. (See attached notification.) Ordi-narily, a prehearing conference is scheduled by the Licensing Board in the vicinity of the plant to consider the intervention petitions. I have asked the Office of the Secretary to inform you of any eventual prehearing conference date.
The Notice contains a summary of the requirements for participation in the pro-ceeding as an intervenor pursuant to 10 C.F.R. 52.714 or as a limited appearee pursuant to 10 C.F.R. 52.715(a) of the regulations. Section 2.715(a) of the regu-lations provides that persons who are not parties to a particular proceeding de-siring to make limited appearances, in the form of oral or written statements, are permitted to do so at the discretion of the presiding officer.

I am enclosing copies of 10 C.F.F. Parts 2 and 50 of the Commission's regulations for your information. A complete copy of the Commission's regulations (contained in 10 C.F.R. Chapter 1), along with existing public documents relating to the Bailly proceeding, are available for public use at the NRC local public document room established at the Westchester Township Public Library,125 South Second Street, Chesterton, Indiana. As they become available, future public documents will be placed in the local public document room.
