PEOPLE AGAINST NUCLEAR ENERGY MOTION TO CLARIFY OR CORRECT FIRST SPECIAL PREHEARING CONFERENCE ORDER In its First Special Prehearing Conference Order, the Board ruled that " General Discove::y shall be completed no more than sixty days after the service of this order." In its Order the Board acted upon most, if not all of the con-tentions, cther than those related to psychological dis-tress. However, it deferred ruling on the psychological distress contentions, the admissibility of which will be finally decided by the Commission.

The result is that parties with psychological distress contentions may not begin discovery on those issues for an unknown period of time, although general discovery ends in 60 days. PANE and other intervenors raising psychological distress contentions could be foreclosed from conducting discovery under the Board's timetable. We seriously doubt that the Board intended this result.

1745 023 s o 01150 / 9 8 (F

In order to assure an equitable opportunity for discovery on these issues, PANE moves that discovery on psychological distress and related contentions be allowed for at least sixty days from service of the Commission's ruling that the contentions must be heard in this proceed-ing.

Respectfully submitted, d [h "
