Appendix A NOTICE OF VIOLATION Rodney Pozderac, M.D.
License No. 21-16042-01 Based on the inspection conducted on November 27, 1979, it appears that certain of your activities were in noncompliance with NRC requirements, as noted below.
Items 1 through 4 are infractions.
1.
Condition No. 14 of your license requires that licensed material be possessed and used in accordance with the statements, representations, and procedures contained in certain referenced applications and letters.
Application dated July 18, 1979, item No.10, references January 1979 Regulatory Guide 10.8, Appendix D.
Appendix D, Calibration of Dose Calibrator, item B states the sources used for instrument accur-acy and constancy tests are 1-5 mci of Co-57 and 0.2 mci of Cs-137.
Contrary to this requirement, it was learned from discussion with the licensee and a review of records that daily constancy checks were not performed as required using the Co-57 and 0.2 mci Cs-137 sources since the inception of the requirement on October 3, 1979. As of the day of the inspection, November 27, 1979, the licensee did not possess either of the required sources.

Appendix C, Instrumentation, states a Victoreen CDV-715 survey meter will be available.
Contrary to this statement, on the day of the inspection, November 27, 1979, the licensee did not possess a CDV-715 survey meter.

10 CFR 20.201(b) requires you to make such surveys (evaluations) as may be necessary for you to comply with all sections of Part 20.
Contrary to this requirement, as of November 27, 1979, you failed to make such evaluations as were necessary to assure compliance with 10 CFR 20.303, a regulation that limits the disposal of licensed material by release to a sanitary sewerage system.
Specifically, you failed to evaluate the releases to the sewerage system.
