I, Richard J. Kiessel, being duly sworn, depose and state:

I am a mechanical engineer in the Mechanical Engineering Branch, Division of Systems Safety of the NRC.
I previously prepared a portion of the "NRC Staff Testimony Regarding Pumphouse Settlement" in this proceeding, dated April 27, 1979.
A copy of my professional qualifications was attached to that document and is located following page 338 of the Transcript for this proceeding.

I prepared the following statement and certify that the infomation contained herein is true and correct to the best of my knowledge and belief.

On November 5,1979, Vepco notified the NRC Staff that it had discovered that an incorrect seismic response spectrum carve had been used in the pipe stress analysis of a number of piping systems including those in the service water pumphouse. The Appeal Board was notified of this discovery by Vepco's letter dated November 6,1979, which went on to state Vepco's belief that this was not relevant to the pending issue of pumphouse settlement.
In its letter of November 8,1979, the Appeal Board requested that Vepco furnish a report which elaborates upon the basis for Vepco's view that it has no bearing upon the pending pumphouse settlement issue. This letter also indicated that the Appeal Board expected the NRC Staff to comnent upon it in writing.
By letter dated December 5,1979, Vepco submitted its " Report on Effect of Outdated Amplified Response Spectrum Curves on Service Water Pumphouse Settlement - North Anna Units 1 and 2."
The NRC Staff has reviewed this submittal noting the followirg salient points:

The revised amplified response spectrum only affects certain portions of the water piping within the service water pumphouse.
- However, because this piping is totally within the pumphouse and is isolated from the absolute and differential settlement loads, it was not involved in the NRC Staff's original assessment of the pumphouse settlement issue. Accordingly, the revised amplified response spectrum is not related to the issue of pumphouse settlement.

The seismic motion of the Service Water Pumphouse, itself, was not affected by the corrections.
3.
The inconsistencies did not apply to the buried piping outside of the service water pumphouse nor to the expansion joints which were analyzed by the NUPIPE service program.
Based on the above, the NRC Staff concludes that the amplified response spectrum inconsistencies recently reported by Vepco do not affect the testimony and conclusions reached by the NRC Staff with respect to the North Anna Unit 1 and 2 pumphouse settlement issue, and are not related to the settlement issue.
