Cranes." Your letter of August 22, 1979 submitted Icevision 1 to the topical report; i.e., copies of both non-prcprietary and prepriet ary replacement sheets for the above docnnents. Both of your letters were accontaried by signed af fi-davits requesting that designated pages identified as proprietary be withheld from public disclosure. We note that your submittals conf or m to our instruc-tions for the handling of company proprietary reports as described in NUREG-0390.

Your reasons for requesting our withholding of this information were that pub-lic disclosure of the infomation sought to be withheld is likely to cause sub-stantial harm to the competitive position of Ederer and deprive or reduce the availability of profit naking opportunities because disclosure could enable competitors to obtain a better understanding of your product and programs and utilize this inf on'ation so as to adversely impact on your sales.

The staff has reviewd your topical report EUR-1 (p) based on the requirements and criteria of 10 CF R 2.790 and have detemined that the above-mentioned docu-ments sought to be withheld contain trade secrets or confidential or proprietary commercial or financial infomation.

The staff also has f ound at this time that the right of the public to be fully apprised as to the bases for and effects of the proposed action does not cut-weigh the demonstrated concern for protection of your cceretitive position.

Accordingly, the staf f has detemined that the information should be withheld from public disclosure.

The staff therefore approves your request for withholding pursuant to Section 2.790 of 10 CFR Part 2 and are withholding the topical report EDR-1 (P) and its Revision 1 fron public inspection as proprietary.

Withholding from public inspection shall not ef fect the right, if any, of per-sons properly and directly concerned to inspect the doctrients.

If the need arises, the staf f may send copies of this information to our consultants working in this area.

The staff will, of course, assure that the consultants have signed the appropriate agreements for handling proprietary data.

If the basis for withholding this information f ron public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC.
