On !bvmber 30, 1979, the Licensing Board entered a Modificaricn of Order Penritting Interini Operation of Trojan Nuclear Plant. That Order had the effect of PrevmH,g the resu:otion of operation of the Trojan nuclear facility (shut dcun since October 12, 1979, to repair stean generator leakage and to inspect P ping supports in inncrossible areas), pending further orders by the Board. Order further provided as follows:

"2. The Staff shall inrnadintely infom the Board, explicitly and clearly, shat unresolved problers renfri which might have a bearing upon the spic nic and other issues in this procaading.

This infeim shall be kept current upon a regular basis.

3. The Licensee shall im,adiately render a full written report to the Board as to the status of all infor:ation requested of it by the Staff and not fully supplied to the Staff's satisfaction.

. 'Ihe Staff, on Deceder 7,1979, filed with the Board an explicit description of the unresolved proble:s which might have a bearing upon the seimic and other issues in this proceeding, in the form of Attachnents. Attach: Dent 1 was entitled

" Affidavit of Kenneth S. Herring on the Unresolved Probles Regarding the Adequacy, Frcxn a Safety Standpoint, of the Proposed Control Building Podifications to Bring the Facility into Substantial Comoliance With the License." Paragraph 4 of Attn %t 1 stated that the " adequacy of the margins against seismic failure, after the rodifications, of the Control Building Comolex itself (i.e., the level of wall structural integrity) has not bem established. Resolution of this major unresolved problem requires the satisfactory resolution of the following itas",

and listed such itms as subparagraphs (a) through (x). Paragraph 5 described another major mresolved problen related to the adequacy of the stiffness assuaed in certain analyses for the derivation of floor response spectra.

- consisted of four affidavits setting forth the unresolved problems with regard to the effects of the proposed codification work itse1# cn plant safety. The Staff deced the unresolved problems described in Attachments 1 and 2 as clearly matters within the jurisdiction of the Board. Attachnent 3 related to the so-called wall problem, which mipit be covered by a license condition (2.C(10).c) already imposed for interim operation. The Staff antici-pated that it would respond to paragraphs (4) and (5) of our November 30 Order, suora, during the week of Decenber 17, 1979.

'Ihe Licensee, on Dece6er 8,1979, furnished information requested 4Mintely by pgaph 3 of the November 30 Order, and filed the affidavits of Robert H. Short and Danald J. Broehl, President and Assistant Vic.e President 1665 071

s respectively of Licensee. Additional data or infor:nc tion was to be filed by D W 13, 15 and 22. 'Ihe Licensee also requested the Board (which we treat as a motim) to issue a further order reInving the prohibition on rest =ption of oporne4nn, describing the adequacy of the infornation furnished and the serious need of the region for electricity at this tize frcm the Trojan facility.

'Ibe Board believes that the public interest requires expeditious considera-tion and resolution of the issues implicit in the Novenber 30 Order, and addressed by the pa:cties in their subsequent filings. Accordingly, a hearirg,will be held on these matters, as well as the establishnent of a schedule for the cccpletion of discovery, filing of notions, and ccx:mencenent of an evidanciary hearing on Phase II issues. 'Ihis hearing will consider all affidavits, analyses and reports filed by the parties and may include the testit:cny of witnesses if degmod necessary to clarify, supplenent or update previously filed infor: nation.

FIEASE TAKE IKTIICE that on Dece1er 28,1979, extending to Dece ber 29, 1979 if necessary, a special hearing will be held at the Bonneville Pcwer Ad::inistra-tion Auditoritu, located at 1002 Northeast Holladay Street, Portland, Oregon, ening at 9:00 a.m., local ti2ne.

'Ihe Licensee, Staff and Interverurs are directed to attend this hearing and to parHeipate. 'Ihe public is invited to attend but there will be no opportunity for public parHeipation during this hearing an motions. A subsequent session will be held at sich public limited appearance statenents may be made, and notice will be given as to the date and place for such limited appearances.
