MEMORANDUM (December 18, 1979)

Today I called Ms. Marcia Mulkey, counsel for the NRC staff, to discuss whether there is a need to shorten the time allotted under the rules for the staff to respond to new contentions (deemed -motions) during the forthcoming discovery period.

I explained that the formal discovery period begins with the board's First Special Prehearing Conference Order which is being issued today; that the board has not received the staff's response to Mr. Sholly's Contentions 16 and 17 ;

and that many intervenors will soon be filing revised emergency planning contentions (December 19); that the board needs time to consider the contention responses by licensee and staff and still provide for adequate discovery time; and that perhaps an order shortening the time for staff responses is necessary.

Ms. Mulkey pointed out that the staff has voluntarily filed papers before due and will continue to do so when possible; that the staff would have responded to Mr. Sholly's new contentions before now even though the response is not yet due, but that the staff's technical persons have been busy with the SER; and that the staff hopes to respond early to emergency planning contentions.

I stated that in view of this, there appears no reason for the board to direct any specific schedule.
