NRC STAFF RESPONSE TO SUBMITTAL BY MARVIN I. LEWIS DATED DECEMBER 10, 1979 In a letter to the Licensing Board dated December 10, 1979, Mr. Marvin Lewis submitted discussion of his interest and previously filed conten-tions, making some references to the Report of the President's Commission on the Accident at Three Mile Island.
In its December 18 First Special Prehearing Conference Order, the Board ruled on the issues of Mr. Lewis' interest and contentions, referencing at page 56 of the Order a number of communications from Mr. Lewis. Since the December 10 letter was not among the material then relied upon by the Board, it could be treated as an objection to the Order pursuant to 10 C.F.R. 52.752(c).
In any event, the NRC Staff hereby states our view that nothing in the December 10 letter should alter the Board's ruling, at pages 56-59 of its Order, regarding Mr. Lewis' interest and contentions.
