CONSUMERS POWER COMPANY APPLICATION FOR REACTOR CONS'fBUCTION PERMIT AND OPERATING LICENSE DOCKET No. 50-329 DOCKET NO. 50-330 AMENDMENT NO. 72 Incorporated herein by reference, supplementing the above-entitled application is Midland Project - Docket No. 50-329 and 50-330, Response to 10 CFR 50.5h Request on Plant Fill - File Oh8516 UFI 71*01 Serial 7914, as revised through November 13, 1979 from Stephen H. Howell, Senior Vice President, Consumers Power Company to US Nuclear Regulatory Commission, ATT: Mr. Harold R. Denton.

In addition, tnis application incorporates by reference the ten interim 10 CFR Section 50.55(e) reports on the settlement of the diesel generator founda-tions and building which Consumers Power Company has made to the Nuclear Regu-latory Commission through November 2, 1979 The referenced documents comprise the licensee's description of remedial actions taken and planned which are associated with the soil activities for safety-related structures and systems founded in and on plant fill material. As previously indicated in the first document referenced above, responses to questions h and lh were to be supplied later. Responses to those questions will be provided by the licensee no later than January 31, 1980.

After the proposed remedial actions have been approved by the NRC Staff, appro-priate FSAR revisions vill be made.
