REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (CNSI Mobile Radwaste Solidification System Topical Report)

By your letter dated July 20, 1979 you submitted for review Chem-Nuclear Systems, Inc., Mobile Radwaste Solidification Topical Report. By your application and affidavit dated October 12, 1979 you requested that those copies of the report which are marked as containing proprietary information be withheld from public disclosure pursuant to Section 2.790 of 10 CFR Part 2.

Your reasons for requesting our witholding of this information were that such information is customarily held in confidence by your company and is not avail-able in public sources; and that public disclosure of the information sought to be withheld is likely to cause substantial harm to the competitive position of Chem-Nuclear Systems, Inc., because of the financial investments and technical expertise required to develop this radwaste solidification system.

We have reviewed your application and material based on the requirements and criteria of Section 2.790 of 10 CFR Part 2 and have determined that the informa-tion sought to be withheld contains trade secrets or confidential or proprietary commercial information.

We also have found at this time that the right of the public to be fully apprised as to the bases for and effects of the proposed action does not outweigh the demonstrated concern for protection of your competitive position. Accordingly, we have detemined that the information should be withheld from public disclosure.

We, therefore, approve your request for withholding pursuant to Section 2.790 of 10 CFR Part 2 and are withholding the copies of the topical report which are marked as containing proprietary information and which contain detailed informa-tion concerning the engineering design and process used in mixing and solidifying liquid radioactive waste.

98 Mr. ' auf s E. Reynolds, Director DEC 0 51973 Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area.

We will, of course, assure that the consultants have signed the appropriate agreements for handling proprietary data.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify us.
