MEMORANDUM CONCERNING THE SECOND STIPULATION REGARDING CERTAIN SUFFOLK COUNTY CONTENTIONS By transmittal letter of November 5, 1979, the parties sub-mitted a "Second Stipulation" relative to Suffolk's contentions.

Before we,act on the stipulation we would like an explanation from the parties regarding the single spaced paragraph on page 2 and footnote 2.

Will the paragraph be incorporated into the technical specifications?

What is the meaning of the first sen-tence of the footnote which appears to be a disclaimer on the part of the Staff?
