Dear Dr. Cochran:
This is in further response to Mr. Anthony Z. Roisman's letter of April 4, 1979 in which he requested, pursuant to the Freedom of Information Act, all documents and communications of any kind received by or in possession of the NRC relating to the Three Mile Island Unit 2 (TMI).
Among the records identified by NRC as being subject to this request are the following documents:
(1) Qualification Test Report for IEEE Class IE Solenoid Valve P/N V52600-515 Valve Type I (2) Test Report for P/N V52600-5291-2 (Code Identification No.
96487)
(3) Appendix I " Sample TR's for Types I, II and III Valves" (S-1602) (Code Identification No. 96487)
These documents contain information which is proprietary and are being withheld from public disclosure pursuant to exemption (4) of the Freedom of Information Act (5 U.S.C. 552(b)(4)) and 10 CFR 9.5(a)(4) of the Comission's regulations.
The public disclosure of this information could cause substantial harm to the competitive position of the submitter of this infonnation.
Fursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The person responsible for this denial is the undersigned.
This denial may be appealed to the Comission's Executive Director for Operations within 30 days from the receipt of this letter. As provided in 10 CFR 9.11, any such appeal must bc 'r. writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Comission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is " Appeal from an Initial F0IA Decision."
