Dear Mr. Martin:
This is in response to your letters dated October 22 and November 12, 1979 in which you requested, pursuant to the Freedom of Information Act, copies of any and all tapes, transcripts and minutes of closed meetings held by the Commissioners which dealt with the structure of the Office of the Executive Director for Operations (ED0).
NRC staff will, at your request, audit tapes of closed Commission meetings for the period extending from March 28, 1979 to the present to locate any discussion pertiner.t to the EDO.
Following that audit, portions of these tapes subject to your request will be reviewed by the Commission.
Such portions as are determined to be releasable will be transcribed and provided to you in the NRC Public Document Room (PDR), located a' 1717 H Street, N.W., Washington, DC.
You should be aware that this process will require time.
Commission staff available to perform this sensitive review is limited, and the process of search, review, and transcription is by nature, time-consuming when a considerable volume of material is involved.
We will make every effort at expedition, but we do not expect completion of this matter until January,1980.
Based on the information contained in your letter of November 12, 1979, your request for a waiver of scarch fees is hereby granted.
We will contact you when the review process is completed.
A document subject to your request entitled "SECY 79-82, Staff Communications with the Commission" dated February 1, 1979 is available at the PDR for public inspection and copying for eight cents ($0.08) per page.
Another document subject to your request is a joint study conducted by the Offices of Policy Evaluation and General Counsel entitled " Review of Delegations of Authority Within NRC."
This report was transmitted to the Commission on October 4, 1979.
Although the report deals with delegations of authority throughout NRC, several sections deal specifically with the EDO and are subject to your request.

from public disclosure at this time pursuant to Exemption 5 of the Freedom of Information Act (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations.
Because the Commission has not yet had an opportunity to review and discuss the report, it is predecisional, and its premature disclosure would adversely affect the Commission's consideration of the report's recommendations. However, we expect that the report will be released in its entirety when the Commission has had an opportunity to review its contents.
Pursuant to 10 CFR 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from producti-on or disclosure and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are Mr. Leonard Bickwit, Jr., General Counsel and Mr. Edward Hanrahan, Director, Office of Policy Evaluation.
This denial may be appealed to the Commission within 30 days from the receipt of this letter.
Any such appeal must be in writing, addressed to the Secretary of the Commission, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."
