IMPOSITION OF CIVIL PENALTIES - $7,000 By EN-78-14, the Commission was notified of the intent of IE to issue a Notice of Proposed Imposition of Civil Penalties in the amount of Ten Thousand Dollars ($10,000) to Wisconsin Public Service Corporation.
The proposed penalties were based on three alleged items of noncompliance with NRC regulations and/or license conditions and involved an entry into the reactor cavity where radiation fields were up to 2000 R/hr.
The Notice was issued on July 19, 1978, and an NRC news release to that effect was made on July 21, 1978.
The licensee responded to the Notice of Proposed Imposition of Civil Penalties in a letter dated August 10, 1978.
After consideration of the licensee's response, an Amended Notice of Violation and an Amended Notice of Proposed Imposition of Civil Penalties in the amount of Seven Thousand Dollars ($7,000) were issued on December 7,1978.
An NRC news release to that effect was made on December 15, 1978.
The licensee responded to the Amended Notice of Proposed Imposition of Civil Penalties in a letter dated January 2,1979.
After consideration of the licensee's response, the IE staff concluded that the items of noncompliance did occur and that no adequate reasons were given by the licensee as to why the penaities for the items of noncompliance should not be imposed as proposed in the Amended Notice.
Accordingly, an Order Imposing Civil Penalties in the amount of Seven Thousand Dollars ($7,000) has been issued today.
The licensee and the State of Wisconsin are being informed by telephone.
Since this matter has been the subject of previous NRC news releases, no additional release is planned.
The Office of Public fffairs will respond to inquiries as received.
Under the terms of the Order, the licensee may, within twenty days of the receipt of the Order, pay the civil penalties or request a hearing.
