OFFICE OF INSPECTION AND ENFORCEMENT EN-79-03A NCTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION July 12,1979 Licensee: Twin City Testing and Engineering Laboratory, Inc.

IMPOSITION OF CIVIL PENALTIES - $2,500 By EN-79-03, dated February 28, 1979, the Commission was notified of the intent of IE to issue a Notice of Proposed Imposition of Civil Penalties in the amount of Four Thousand Five Hundred Dollars ($4,500) to the Twin City Testing and Engineering Laboratory, Inc. The proposed penalties were based on two alleged violations of NRC requirements involving a personnel exposure of about 21.6 rems and a failure to make a proper survey of the radiographic exposure device following a radiographic exposure. The Notice was issued on March 2,1979, and a news release to that effect was made on March 7, 1979.
The licensee responded to the Notice of Proposed Imposition of Civil Penalties in a letter dated March 20, 1979. After consideration of the licensee's response the IE staff concluded that the items of noncompliance did occur but that the penalties proposed for the two items should be mitigated from Four Thousand Five Hundred Dollars ($4,500) to Two Thousand Five Hundred Dollars
($2,500).
Accordingly, an Order Imposing Civil Monetary Penalties in the amount of Two Thousand Five Hundred Dollars ($2,500) has been issued today.
The licensee and the State of Minnesota are being informed by telephone.
Since this matter has ucen the subject of an NRC news release, no additional release is planned; The Office of Public Affairs will respond to inquiries as received.
Under the terms of the Order, the licensee may, within twenty days of the receipt of the Order, pay the civil penalties or request a hearing.
